Hunger Strike unto death against the harassment from Taloja Central Jail’s apathetic administration.

I, Sagar Tatyaram Gorakhe, am a Political Prisoner under the Elgar Parishad Bhima Koregao Case, and have been locked up in the Taloja Central Jail since September 2020. It is with extreme distress that I inform you that since the very beginning the prison administration has treated the Bhima Koregao Case accused with utmost prejudice. As a result, the prison has become a torture camp for my co-accused and me. As you must be aware that it was the maltreatment by the prison administration that led to the custodial death of Father Stan Swami last year. Even today our basic human rights are being trampled over every day in the prison. It is because the situation has become absolutely unbearable that I must resort to an agonising hunger strike in protest. …

The Peoples Union for Civil Liberties welcomes the order of the Supreme Court dated 11.05.22 in the petition filed by Army veteran Major-General SG Vombatkere (Retired) as well as PUCL and a range of other petitioners challenging the constitutional validity of Section 124-A of the Indian Penal Code, 1860. In its petition, the PUCL had pleaded that owing to the development of constitutional law, the law of sedition of the colonial era had no place; it was overbroad, vague, arbitrary, violating the sacrosanct freedom of speech and expression, hence it was imperative to strike it down as it was unconstitutional.

Suspending sedition: No cause for celebration

There really is no cause for celebration after the conditional suspension of the infamous Section 124 A, otherwise known as the Sedition Act of 1870. The statute books have so many other equally infamous laws, starting with the Unlawful Activities (Prevention) Act amended and strengthened in 2019, and the 2019 expansion of the National Investigation Agency Act that dumping a “colonial-era” law and claims to be respectful of human rights and liberties is a phoney gesture.

In spite of the Supreme Court’s insistence on the right to bail, people are denied relief at the drop of a hat.
The prime minister’s eloquent appeal on behalf of under-trial prisoners could not entirely erase the memory of incarcerated activists in the so-called Bhima-Koregaon case, for example, or protesters against the new citizenship laws.
The prime minister got it right. At the joint conference of chief ministers and high court chief justices, in which the Chief Justice of India delivered a speech reportedly mentioning how governments contributed to the courts’ caseload, Narendra Modi mentioned the staggering figure of 3.5 lakh under-trial prisoners in his own speech.

Peaceful resistance was the cornerstone of Stan’s work, and that is why the state failed in breaking his spirit.
It may take time to get the Bombay High Court to clear Jesuit Father Stanislaus Lourduswamy’s name in the so-called Elgar Parishad case.
And it may take longer to get the Vatican machinery to launch the formal process to grant Sainthood to the 84-year-old priest, whose work among the Adivasis of central India and the poorest of the poor earned him the ire of mine-owners, state governments, and finally the central government.

This is the third consecutive year when United States Commission on International Religious Freedom (USCIRF) has designated India as such.
… The latest report, in a section devoted to India, has accused the Narendra Modi government of muzzling dissenting voices, misusing UAPA and sedition laws, allowing illegal arrests of rights’ activists, carrying out violent attacks against Muslims and Christians and creating “hurdles” for NGOs to receive funds from abroad for charity work.
It has also prominently discussed the arrest and custodial death of Father Stan Swamy.

Other countries recommended for this designation by the USCIRF in its annual report are Pakistan, China, Iran, North Korea, Russia, Saudi Arabia, among others.
… “The UAPA and sedition law have been invoked to create an increasing climate of intimidation and fear in an effort to silence anyone speaking out against the government,” it said.
The report specifically mentioned the treatment meted out to 84-year-old Stan Swamy, a Jesuit priest who was arrested in the Bhima Koregaon case.

The 2021 Freedom to Write report recently published by Pen America, an NGO, has detailed the arrests of eight people in the country, which includes comedian Munawar Faruqui and those arrested in the Bhima Koregaon case.
India has the dubious distinction of figuring among the top ten list of countries that jail writers, academics and intellectual for their writings, works and advocacy.

Tomorrow, 14th April 2022 marks the completion of two years of PUDR activist Gautam Navlakha’s surrender before the NIA. One of sixteen accused in the infamous Bhima Koregaon case, Gautam has been imprisoned in Taloja Central Jail, Navi Mumbai since 25 May 2020. For more than six months now, since 12 October 2021, the nearly 70 years old Gautam, an undertrial suffering from multiple health problems has been in solitary confinement in one of 33 cells in the ‘anda’ circle, the High Security Area of Taloja Jail, a space meant to segregate those guilty of heinous crimes.
