The commission’s focus on religious freedom in India is welcome and timely.
Over the last decade there has been an undeniable increase in the number and frequency of attacks against religious minorities in India, especially Muslims and Christians.
… We have also repeatedly flagged human rights consequences of the government’s 2019 revocation of the constitutional autonomy of India’s only Muslim-majority state, Jammu and Kashmir. Today, four years later, authorities there are still restricting free expression, peaceful assembly, and other basic rights, and regularly shut down the internet. Several journalists and human rights defenders have been arrested on spurious terrorism charges and authorities regularly harass critics, including through use of counterterrorism raids.

The National Investigation Agency (NIA) court also directed the NIA to state in its affidavit that the prosecution would not be relying on any documents other than those for which hard disks have been given to the accused.
On Monday, a National Investigation Agency (NIA) court of special judge Rajesh Kataria directed the NIA to file an affidavit stating that it has provided cloned copies of seized electronic evidence to the accused persons in the Bhima Koregaon–Elgar Parishad Maoist links and criminal conspiracy case.
… The NIA is required to submit the affidavit on the next date of hearing, that is, October 5.

The senior advocate said that the law has strict bail conditions and allows extension of custody of an accused from 90 to 180 days before chargesheet is filed.
It is tragic that people booked under the Unlawful Activities (Prevention) Act continue to remain incarcerated on little or no evidence due to the stringent sections in the law, senior advocate Rebecca John said on Saturday, reported Live Law.
John, who has represented activists Vernon Gonsalves and Arun Ferreira in the Bhima Koregaon case, made the remarks during a panel discussion held for the launch of the book, Unsealed Covers: A Decade of the Constitution, the Courts and the State by author Gautam Bhatia.

Ambedkar rejected the allegation, saying the first meeting called by retired Justice Sawant and Justice B G Kolse Patil was on the issue of the widening divide between the OBCs and Marathas.
Dalit leader and president of Vanchit Bahujan Aghadi Prakash Ambedkar on Saturday told the the Koregaon Bhima Commission of Inquiry that the main aim of holding the Elgaar Parishad in Pune was to defuse the social tension created between the Other Backward classes (OBC) and the Marathas on the issue of reservations.

Activist Harshali Potdar, who is among the organisers of the ‘Elgaar Parishad’, was questioned about an article written by scholar Anand Teltumbde on the ‘myth’ related to the battle of Koregaon Bhima during her cross-examination before the Koregaon Bhima Commission of Inquiry on Thursday.

Some of the accused activists have finally been granted bail. But charges have not been framed even five years after their arrests.
On 1 January 2018,  protests and violence spread across Maharashtra following an attack on a gathering of Dalit persons at Bhima Koregaon. At least one person died and three others were injured. An investigation which began with FIRs lodged against pro-Hindutva leaders then took a baffling turn, with a number of renowned activists being arrested for instigating violence through inflammatory speeches at the event, which is also called Elgar Parishad.

Additional Solicitor General of India Devang Girish Vyas, representing the NIA, argued that as an active member of the banned Communist Party of India (Maoist), Mahesh Raut recruited members and received funds to further its activities, and he was a participant in the Elgar Parishad event that had led to violence. 
… With the conclusion of arguments on both sides, the matter is reserved for judgment on September 21.

Division bench of Bombay High Court has reserved its order on activist Mahesh Raut’s bail plea in the Elgar Parishad Maoist links case. The order will be issued on September 21.
The Bombay High Court, on Tuesday, reserved its verdict on the bail plea of activist Mahesh Raut, who stands accused in the Bhima Koregaon–Elgar Parishad Maoist links and criminal conspiracy case.
Advocate Mihir Desai, representing Raut, cited several high court and Supreme Court orders where Raut’s co-accused were granted bail and argued that his case is on par with theirs.

Bombay high court on Tuesday reserved for orders a bail plea filed by Mahesh Raut, a 34 year old researcher from Chandrapur, accused in the January 2018 Elgar Parishad case. The HC bench of Justices Ajay Gadkari and Sharmila Deshmukh said it would pass orders on September 21 or by September 26.

Senior advocate Mihir Desai, appearing on behalf of Mahesh Raut, took the court through material cited by the National Investigation Agency, claiming lack of evidence against Raut. Desai sought parity with judgments granting bail to other co-accused persons— Dr Anand Teltumbde, Vernon Gonsalves and Arun Ferreira. 
On Monday, a division Bench of the Bombay High Court comprising Justices A.S. Gadkari and Sharmila U. Deshmukh heard the bail plea of forest rights activist Mahesh Raut.

The National Investigation Agency was directed to comply with the predecessor judge’s Order dated May 23, 2022, directing the it to provide a chart on data of documents.
On Tuesday, a National Investigation (NIA) court of special judge Rajesh Kataria directed the NIA to provide a chart of the data of the cloned copies of seized documents in the Bhima Koregaon-Elgar Parishad Maoist links and criminal conspiracy case.
The plea is for the NIA to comply with Section 207 (supply of a copy of the police report and other documents to the accused) of the Code of Criminal Procedure (CrPC).
