The senior advocate said that the law has strict bail conditions and allows extension of custody of an accused from 90 to 180 days before chargesheet is filed.
It is tragic that people booked under the Unlawful Activities (Prevention) Act continue to remain incarcerated on little or no evidence due to the stringent sections in the law, senior advocate Rebecca John said on Saturday, reported Live Law.
John, who has represented activists Vernon Gonsalves and Arun Ferreira in the Bhima Koregaon case, made the remarks during a panel discussion held for the launch of the book, Unsealed Covers: A Decade of the Constitution, the Courts and the State by author Gautam Bhatia.

Additional Solicitor General of India Devang Girish Vyas, representing the NIA, argued that as an active member of the banned Communist Party of India (Maoist), Mahesh Raut recruited members and received funds to further its activities, and he was a participant in the Elgar Parishad event that had led to violence.

Division bench of Bombay High Court has reserved its order on activist Mahesh Raut’s bail plea in the Elgar Parishad Maoist links case. The order will be issued on September 21.
The Bombay High Court, on Tuesday, reserved its verdict on the bail plea of activist Mahesh Raut, who stands accused in the Bhima Koregaon–Elgar Parishad Maoist links and criminal conspiracy case.
Advocate Mihir Desai, representing Raut, cited several high court and Supreme Court orders where Raut’s co-accused were granted bail and argued that his case is on par with theirs.

Bombay high court on Tuesday reserved for orders a bail plea filed by Mahesh Raut, a 34 year old researcher from Chandrapur, accused in the January 2018 Elgar Parishad case. The HC bench of Justices Ajay Gadkari and Sharmila Deshmukh said it would pass orders on September 21 or by September 26.

Senior advocate Mihir Desai, appearing on behalf of Mahesh Raut, took the court through material cited by the National Investigation Agency, claiming lack of evidence against Raut. Desai sought parity with judgments granting bail to other co-accused persons— Dr Anand Teltumbde, Vernon Gonsalves and Arun Ferreira. 
On Monday, a division Bench of the Bombay High Court comprising Justices A.S. Gadkari and Sharmila U. Deshmukh heard the bail plea of forest rights activist Mahesh Raut.

A Supreme Court Bench of Justices Aniruddha Bose and Sudanshu Dhulia last month granted bail to Bhima Koregaon accused Vernon Gonsalves, five years after he was arrested under the anti-terrorist legislation UAPA.

The bail conditions set by the Supreme Court during the grant of regular bail to Vernon Gonsalves and Arun Ferreira mandated pairing mobile phones of the duo with the devices of the investigating officers. Now the National Investigation Agency has said that the concerned investigating officers stand to lose their privacy.
“If you gaze for long into an abyss, the abyss gazes also into you,” wrote German philosopher Friedrich Nietzsche in his book Beyond Good And Evil.
The National Investigation Agency (NIA) seems to have discovered the meaning of the quote recently.

Discussing the Supreme Court’s decision in granting bail to activists Vernon Gonsalves and Arun Ferriera accused in connection with the Elgaar Parishad case, members from People’s Union for Civil Liberties said the bail order has significant implications for bail jurisprudence under the Unlawful Activities (Prevention) Act, UAPA, in the framework of criminal law.
The members highlighted the top court’s bail-granting powers under the UAPA, which flows from the Zahood Ahmad Watali judgment.

People’s Union for Democratic Rights (PUDR) welcomes the Supreme Court order granting bail on merits and release of Vernon Gonsalves and Arun Ferreira, two of the accused in the infamous Bhima Koregaon case under the Unlawful Activities (Prevention) Act (UAPA).
In a significant judgement, on 28 July 2023, the top court granted bail for two primary reasons: the fact that the accused had already been incarcerated for 5 years with the trial not having commenced yet, and that the NIA had been unable to justify, even prima facie, the allegations against them.
… However, what is even more disturbing is that the apex court has allowed for further conditions to be set by the special trial court, conditions that the latter may “consider fit and proper”. Accordingly, on July 31, the special NIA court has set further conditions which prohibit the duo from:

A Supreme Court bench is currently adjudicating the constitutionality of such a bail condition.
… The two-judge bench of the court comprising Justices Aniruddha Bose and Sudhanshu Dhulia on Friday imposed unusually restrictive bail conditions on Ferreira and Gonsalves. One of them is the requirement of keeping “the location status of their mobile phones active, 24 hours a day” and “pair[ing]” their phones with those of the investigating officer of the National Investigation Agency to enable the officer to identify Ferreira’s and Gonsalves’ exact location “at any given time”.
While this may sound like an uncommon bail condition, it has featured in three previous orders of the Supreme Court over the last nine months. In all four instances, Justice Bose was part of the bench that passed the order. The Delhi High Court has passed over 800 bail orders with this condition.

The release of activists Vernon Gonsalves and Arun Ferreira, accused in the Elgar Parishad-Maoist links case, could get delayed as a special NIA court here on Monday rejected their pleas for temporary cash bail.
The court imposed additional conditions for their bail, directing the accused to furnish a PR (personal recognisance) bond of Rs 50,000 each and desist from speaking to the media about the case.

The apex court, while giving relief, asked them not to leave Maharashtra and surrender their passports to the police.
Activists Vernon Gonsalves and Arun Ferreira, accused in the Elgar Parishad-Maoist links case, are likely to walk out of jail only next week after securing bail from the Supreme Court on Friday as certain formalities are to be completed before they are released, defence lawyers said here.
