BK-16 PRISON DIARIES: MINAL GADLING ON THE MANY CRUELTIES, IRONIES AND INJUSTICES OF SURENDRA’S IMPRISONMENT

To mark six years of the arbitrary arrests and imprisonment of political dissidents in the Bhima Koregaon case, The Polis Project is publishing a series of writings by the BK-16, and their families, friends and partners. By describing various aspects of the past six years, the series offers a glimpse into the BK-16’s lives inside prison, as well as the struggles of their loved ones outside. Each piece in the series is complemented by Arun Ferreira’s striking and evocative artwork.

6 June 2024 marked six years since Surendra was arrested. Six long years! It is very difficult to talk about this time in a few words. During these six years, life completely changed. Life, which earlier meant stability, security, friends, relatives, and happiness, was suddenly altered completely, and I found myself forced to face a reality that I could not have imagined in my worst nightmares.
I recall that grim dawn of 17 April 2018, when our house was raided; that sinister morning of 6 June 2018, when Surendra was taken away.

Since reaching power, Narendra Modi’s Bharatiya Janata Party has jailed political critics using bogus terrorism and incitement charges. But an electoral setback for his party offers hope of change in India and a crack in his authoritarian Hindutva order.
… There are those who do make it out of prison. But in one harrowing case, imprisonment under the UAPA became a death sentence. In 2018, violent clashes broke out between Dalits and Hindu militant groups in Bhima Koregaon, a village in Maharashtra state. Instead of arresting any militants, police in the state arrested sixteen eminent activists, academics, and lawyers over the next two years — all of whom were involved in civil rights work supporting marginalized Dalits and tribal Adivasi communities.

Intimations on the sixth year of continuing incarceration of the BK-16.
We live in a moment where truth is treason. Under the fascist onslaught of Brahmanical Hindutva, truth has become consumed with fear – the fear of being watched, being surveilled, being criminalised, neutralised, or even eliminated. But the fear, at the end, is itself a whistleblower.
We, the BK 16, known after the eponymous Bhima Koregaon case, complete six years of incarceration on June 6, 2024 under the stringent anti-terror law, UAPA [Unlawful Activities (Prevention) Act], where the onus is on the accused to prove their innocence; under heavy odds against the Modi dispensation that dubs speaking truth to power treason, anti-Hindu, an act of terror.

Elgar Parishad case accused Surendra Gadling filed an appeal challenging a June 28, 2022 order of the special NIA court, that refused to grant default bail to him.
The Bombay High Court on Friday, reserved its order on the default bail petition of accused Surendra Gadling in the 2018 Elgar Parishad case.

Accused in the Bhima Koregaon case and released on bail by the Supreme Court last year after having spent five years in prison without a trial, Vernon Gonsalves narrates a sordid tale of pathetic medicare in Indian jails. 

I have spent almost eleven years in detention, with considerable periods in the most populated prisons of Maharashtra. My first incarceration from 2007 to 2013 began shortly after I turned fifty. I had a second stint from 2018 to 2023, while I was in my sixties.

The injustice of a trial judge filling the gaps in the prosecution’s case (which relied on ‘evidence’ in the form of bananas, umbrellas and newspaper cuttings) with judicial overreach to chop ten years off Professor G.N. Saibaba’s life.
The Nagpur Bench of the Bombay High Court heard the appeal against the conviction of Prof. G.N. Saibaba and five others, twice. In both the judgments, it set aside the conviction.

Celebrating the International Day of Solidarity with Political Prisoners, which fell on March 18, the Campaign Against State Repression (CASR), a joint platform of 35+ organizations, held a public gathering in Delhi titled “Life in Anda Cell: Political Prisoners and Wrongful Incarcerations” at the Press Club of India, Delhi, in order to mark the acquittal and prison experience of cultural activist Hem Mishra and his family. 
… Hem Mishra added, “it is not about just the 6 of us in my case. It is about all political prisoners. As long as the fight for jal-jangal-jameen remains, as long as the fight of Dalits, Adivasis, workers, peasants, oppressed nationalities remains, as long as the question of creating a better world for all people and a better state for all people remains, the fight of all political prisoners will rage on. At the end of the day, I am a bard who sings the songs of the people and I will continue to echo their cries. I am out of prison, but as long as all other political prisoners like Rona Wilson, Surendra Gadling, Sudhir Dhawale are inside prison, I feel I am only out from a smaller cage into a bigger one.”

The Pune police, at multiple places in the Elgar Parishad chargesheet, claimed that some of those arrested in the Elgar Parishad case had a “direct association” with Saibaba.
At the end of 2018, when the Pune police first filed a chargesheet in the Elgar Parishad case, they claimed to be “heavily relying” on the investigation conducted in the case involving former Delhi University professor G.N. Saibaba. By then, Saibaba and five others had already been convicted by the Gadchiroli sessions court.

The Committee for Defence and Release of GN Saibaba appealed to the Supreme Court to reject the appeal filed by the Maharashtra government against his release.
… They also asked the government to repeal the draconian UAPA law. “All charges against intellectuals and activists who have been similarly falsely detained under the UAPA in particular, such as those charged in the Bhima-Koregaon case, or those arrested during the anti-CAA/NRC struggle, should be dropped and they should be immediately released.

The judgment quotes the Supreme Court’s order granting bail to Vernon Gonsalves, an accused in the Bhima Koregaon case. Will this judgment in turn be helpful in the Bhima Koregaon case, especially with regard to the way police collect and present electronic evidence?
Yes, on electronic evidence, this judgment is a precedent. It lays down that not taking the hash value renders the evidence of no real value. This is also what happened in the Bhima Koregaon case.
