Friends and Family of Sudha Bharadwaj are extremely worried over the alarming and disturbing news of the rising Covid-19 infection in Byculla women’s jail forcing the authorities to seal the premise.
Last week, in a prison supervised phone conversation Koel Sen had with her mother Shoma Sen, former professor of English from Nagpur University, arrested in the Bhima Koregaon case and incarcerated for the last three years in Byculla prison without trial, it was informed that 20 inmates from the prison were infected, which appears to have now risen to 39!
Three women political prisoners, Shoma Sen, Sudha Bharadwaj and Jyoti Jagtap, all arrested in the Bhima Koregaon case for the past three years without trial and bail, are housed in the women’s prison of Byculla jail. Alarmingly, two out of the 20 infected are from the barrack that houses 40 senior women inmates, including 61-year-old Shoma Sen and 59-year-old Sudha Bharadwaj. The barrack of 40 senior citizen women inmates is fully vaccinated, however the virus infection of the two fully vaccinated women has sent fear and concern to all the women inside the prison and their family waiting for them in their homes.

On July 5, 2021, 83-year-old activist and priest Father Stan Swamy passed away in a Mumbai private hospital while in judicial custody for his alleged involvement in the riots that took place in Bhima Koregaon post the Elgar Parishad event held on January 2018.
His death highlighted the state of undertrials in the Bhima Koregaon case, most of whom have been awaiting trial for the past three years.

On 11 June 2021, I wrote a letter jointly with two other UN experts on the alleged inhumane prison conditions and deteriorating condition of 15 human rights defenders, as well as Varavara Rao who was granted medical bail.
Of pressing concern was the inhumane prison conditions and deteriorating health of the human rights defenders. The death of Fr. Stan Swamy shortly after this communication was written demonstrate the severity of the conditions in which the human rights defenders are being held. It is haunting to now read how Fr. Swamy’s requests to be transferred to hospital to receive treatment were initially denied repeatedly.

Despite several directions from the Supreme Court and high court to decongest its overcrowded prisons in view of the COVID-19 pandemic, the state government has neglected the issue.
… The total prison capacity of Maharashtra’s jails is 24,032. As of March 31 this year, 35,124 prisoners were languishing across different Central and district prisons. In April, the number must have further increased. This alarmingly high number – 11,000 more than the actual capacity or 146% occupancy – continues even after the state was directed to work towards decongesting prisons over a year ago.
… Cultural and anti-caste activist Jyoti Jagtap, who was arrested last year for her alleged role in the Elgar Parishad case, is among those who have been infected and has been kept at a temporary centre. Her lawyers have been struggling to establish contact with her to know her medical condition. The temporary set-ups lack basic telephone facilities and many prisoners’ families have complained of their inability to check on the health and well-being of those incarcerated. Meanwhile, advocate and academic Sudha Bharadwaj, arrested in the same case and Jagtap, has started showing symptoms.

US cyber forensics firm, Arsenal Consulting has released a second report reaffirming the planting of ‘incriminating documents’ into Rona Wilson’s (a co-accused in the case) computer through use of an external malware. Crucially, one of the incriminating documents relied upon by the prosecution against Sudha Bharadwaj was found on Rona Wilson’s computer. In its report Arsenal Consulting has claimed that this document was remotely planted.

This report only substantiates what Family and Friends of Sudha Bharadwaj have consistently and independently maintained since the first raid in her house on 28th August 2018 that she is innocent and has been incarcerated for nearly three years on the basis of fabricated evidence.
