Raises Ongoing Concerns About Fraying of Free Expression and Jailing and Silencing of Writers

(NEW YORK)—As India marks 75 years of independence today, 102 notable U.S. and international writers and creative artists, including Marina Abramovic, Paul Auster, J.M. Coetzee, Jennifer Egan, Jonathan Franzen, Azar Nafisi, and Orhan Pamuk, joined PEN America and PEN International in signing a letter to Indian President Droupadi Murmu, raising concern over the deterioration of free expression and calling for the release of imprisoned writers and dissident and critical voices…
Seven of the eight writers in prison in India during 2021 have been detained in connection with the ongoing Elgar Parishad case, concerning a deadly inter-caste altercation in the village of Bhima Koregaon in 2018. In response, state- and national-level authorities detained a broad swathe of leftist writers and intellectuals, accusing them of inciting the violence and of links to banned groups.

I am not allowed to say the name of the person who told me, years ago: “India is not a nation. It is a prisonhouse of all possible nations.” Now this person is incarcerated, but I can’t describe the specifics of their suffering…
I can say the name of Stan Swamy, incarcerated and, eventually, killed by the Indian state on July 5, 2021. I can say his name because his life, if not his memory, is beyond the reach of the prisonhouse. Father Stan, dead at 84 because those running India are terrified of a Jesuit priest whose life was dedicated to working with indigenous people brutalized by Hindutva, the state, and the market.

Nagpur-based lawyer Surendra Gadling, an accused in the Elgaar Parishad case who has been behind bars since 2018, claimed that the Enforcement Directorate (ED) has a “hidden agenda” to implicate him in another “false case” to make it difficult for him to secure a release.

The interrogation takes place despite the fact that Gadling has questioned the basis of ED’s investigation.
On August 10, the National Investigation Agency (‘NIA’) court, presided by Special Judge Rajesh Kataria, allowed the Enforcement Directorate (‘ED’) to record human rights lawyer and Dalit rights activist Surendra Gadling’s statement on his alleged connection with money laundering. According to the NIA court’s order, whether there are proceeds of crime or not falls under the purview of investigation and hence, interrogation by the ED needs to be permitted. Accordingly, Gadling will be interrogated from August 17 to August 19, in Taloja Central Jail.

The Special NIA Court has allowed the Enforcement Directorate to record accused-advocate Surendra Gadling’s statement in a money laundering case registered last year against certain accused in the Bhima Koregaon – Elgar Parishad Case.
Special Judge Rajesh Katariya passed the order on ED’s plea seeking to record Gadling’s statement under section 50(2) of the PMLA Act inside Taloja Prison. The agency has been allowed to record his statement on 17,18 and 19 August, 2022.

The central agency has sought permission from a court in Mumbai to investigate into the enforcement case information report (ECIR) registered against the activist in March 2021.
The Enforcement Directorate on Thursday, July 28, moved an application before a special court seeking permission to question Surendra Gadling, one of the activists jailed in the Elgar Parishad case, in connection with an enforcement case information report (ECIR) registered against him in March 2021.
The Nagpur-based human rights activist has already been in jail for four years and will now be probed by ED in a “money laundering” case.

On July 5, 2021, Jesuit Priest and human rights defender Father Stan died in Indian custody at the age of 84. He was the oldest person to be arrested by the Indian government for terrorism. Father Stan’s incarceration led to a global outcry against the Indian government’s brutal treatment of Indian human rights defenders.
Father Stan is one of a mushrooming group of prisoners of conscience whom the Indian government has jailed over the past few years.

News is always “breaking” and stories are sometimes “broken”. But then you also have important stories that are “broken” but are quickly forgotten. Not always deliberately, although sometimes that is the case. Quite often because there is just too much news breaking all around us, genuine and fake. As a result, many important stories that need to be followed up are relegated to the archives.
… But first to an important investigative story that got barely reported in the Indian media.
I refer to the remarkable story broken by the Wired magazine on June 16. Headlined “Police linked to hacking campaign to frame Indian activists”, the story describes in some detail how the Indian police were able to plant evidence on the computers of some activists that ultimately led to their arrest.

During the cross-examination before the Koregaon Bhima Commission of Inquiry, activist Harshali Potdar was questioned about an article written by Anand Teltumbde in memory of Sridhar Srinivasan, the alleged central committee member of the banned CPI-Maoist.
Alleged to be a top urban operative of the banned organisation, Sridhar was arrested along with his aide Vernon Gonsalves by the Maharashtra Anti-Terrorism Squad (ATS) in 2007.

Varavara Rao is currently on bail on medical grounds, and had challenged in the Supreme Court the High Court order rejecting his appeal.
… Incidentally, the High Court had also noted the claims made by Rao’s counsel on the lack of medical facilities at the Taloja prison and the poor hygienic conditions there, saying there was substance in the argument.
In the trial in the case, the Elgar Parishad accused have repeatedly brought up the lack of facilities in prison, and denial of access to the same.

A special court that recently rejected the default bail pleas of five of the Bhima Koregaon – Elgaar Parishad accused, has said in its reasoned order for doing so, that the ground on which they were seeking bail was already considered and decided by the Bombay High Court and they had no right to raise it in their present pleas.
The applications were filed by Surendra Gadling, Sudhir Dhavale, Rona Wilson, Shoma Sen and Mahesh Raut.

On Father Stan Swamy’s Death Anniversary, Elgar Parishad Activists Observe Protest Fast in Prison

Activists and lawyers have accused the jail administration of inhuman treatment towards and lack of adequate medical care for the priest and other accused in the case.
On July 5, last year, 84-year-old Jharkhand-based tribal rights activist Father Stan Swamy died in judicial custody in Mumbai.
Swamy was the 16th and last person to be arrested in the highly controversial Elgar Parishad case. He, like his co-accused in the case, suffered from prolonged and serious health complications while in custody. Swamy passed away after testing positive for COVID-19. His co-prisoners and lawyers have blamed the state for not allowing adequate medical help to reach him on time.
A year later, protesting against alleged state apathy and lack of accountability, 11 of his co-prisoners have decided to observe a day-long fast on the day of Swamy’s passing.

The protesting activists alleged that the death of Father Stan Swamy (83) was “brutal assassination by the prison administration, the NIA, and the government.” Swamy’s co-accused and activist Sudhir Dhawale, in a letter written to the Taloja prison superintendent and the case lawyers, claimed there has been no change in the jail condition, including general apathy among the prison administration and lack of medical facilities, which were among the several causes that led to Swamy’s death.

A special National Investigation Agency (NIA) court on Tuesday rejected the default bail plea of five accused in the Bhima Koregaon caste violence case.
Special NIA judge Rajesh Katariya rejected the pleas of former professor of Nagpur university Shoma Sen, advocate Surendra Gadling, activist Sudhir Dhawale, Rona Wilson and Mahesh Raut. All of them were arrested on June 6, 2018 from different locations.
