The PUCL welcomes the short order of the Supreme Court  yesterday, 07th December, 2021, dismissing the SLP filed by the NIA which challenged the grant of statutory bail to Advocate Sudha Bharadwaj, a committed activist lawyer and member of PUCL. The PUCL sees this important order and the order of the Bombay High Court which was under challenge, as a vindication of the long campaign against the UAPA by the PUCL and other allied groups.

On the 1st of December 2021, after having spent three years in jail on fabricated charges in the Bhima Koregaon case, Human Rights activist and lawyer Sudha Bharadwaj was granted bail by the Bombay High Court. We the undersigned unions and workers collectives welcome the judgement. It is a great relief for the working people of Chhattisgarh who have consistently campaigned against the illegal arrest of Sudha Bharadwaj and continuously demanded her release.

PUCL Chhattisgarh welcomes the granting bail to Advocate Sudha Bharadwaj by the Bombay High Court and at the same time is dissapointed that the other 8 co-accused have been denied bail.
It should be mentioned that the violence inflicted by Hindu groups on and after the Bhima Koregaon celebrations in January 2018 have cost lives and resulted in several incarcerations. Including the 8 whose bail was rejected by the Bombay High Court, however, a total of 16 people have been falsely implicated in the Bhima Koregaon Case and have been in jail for years on fabricated charges under the draconian UAPA. Many others have been targetted, arrested and had their homes raided.
Father Stan Swami, one of the 16, aged 84, lost his life in custody while awaiting bail.
In Chhattisgarh there are hundreds of Adivasis who have been imprisoned under the UAPA and have been awaiting bail for years. On March 9 this year, at a program to mark International Womens Day and speak out against sexual violence inflicted on women by the police and paramilitary in Bastar, Human Rights Defender Hidme Markam was arrested and later jailed under the same draconian act.
While we eagerly await the release of Advocate Sudha Bharadwaj, and for her to return amongst us, we also pledge to strengthen the struggle for release of all those imprisoned under false charges, against the UAPA and against the countrys casteist carceral system.

Sudha Bharadwaj’s application for default bail was pending on the date the application for extension of time to file chargesheet was made.
While granting default bail to lawyer and activist Sudha Bharadwaj on Wednesday, the Bombay High Court refused bail to eight other co-accused in the Bhima Koregaon case.
The Bench of Justices SS Shinde and NJ Jamadar made certain interesting observations in the 120-page order while deciding the pleas filed by Bharadwaj and 8 others challenging orders of the Pune Sessions Judges.

In the context of what has happened in recent times concerning cases of Bhima Koregaon, Delhi riots, Tripura violence, farmers protest, the tool kit case, Siddique Kappan case and various others across the country, Khurram’s arrest is one more instance of a brutalizing state machinery being used against human rights defenders.

The Bombay High Court on Wednesday granted the National Investigation Agency (NIA) two weeks to respond to Dalit scholar Anand Teltumbde’s bail appeal.
Teltumbde has filed two petitions; the first is an appeal against the special court’s order rejecting his bail application and the second is a petition challenging the constitutional validity of certain provisions of the the Unlawful Activities (Prevention) Act.

The activist has filed another petition challenging the constitutional validity of certain provisions of the Unlawful Activities (Prevention) Act.
… The central agency has accused Teltumbde of being the convenor of the Elgaar Parishad conference held on December 31, 2017, that led to Bhima Koregaon violence the next day. It has alleged that the activist was an active member of the CPI (Maoist) and was “deeply involved in furtherance of its furtherance of its agenda.”

Over 160 civil society, labour and farmers’ organisations will as part of a nationwide campaign on Independence Day take a pledge to fight draconian laws, uphold the right to question and show dissent and oppose State actions that “deprive us of the freedoms of speech and opinion”.
The movement, named National Campaign to Defend Democracy and spearheaded by the People’s Union for Civil Liberties (PUCL), the Jharkhand Janadhikar Mahasabha (a conglomeration of human rights organisations) and trade unions, will also seek justice for Father Stan Swamy.

The Institutional murder of the 84-year-old Jesuit priest Father Stan Swamy in judicial custody on 5th July 2021 has brought home to all of us the urgency of the need to take up the defence of democracy against repressive laws. Father Stan, who spent a lifetime working with Adivasis in Jharkhand in defence of their rights, was arrested in the Bhima Koregaon case even though he had no connection with it and the police did not require him for any investigation. Father Stan died waiting for a chance to clear his name. In denying Fr Stan bail, the NIA judge, D. E. Kothalikar argued that “the collective interest of the community” outweighed Fr. Stan’s right to personal liberty. His death should shake the conscience of the nation and the judiciary as it “brings to an end a stark tale of injustice – one that has left the highest institutions of India’s justice system diminished.” But even after Father Stan’s death, the same court denied bail to Anand Teltumbde, another member of the BK-16, as the advocates, artists, journalists and intellectuals who have been imprisoned under the Bhima Koregaon case are called. …
