I Spoke to Sudha Bharadwaj for two hours over the phone. Out on bail after spending over three years in jail, where she had been packed off for her alleged role in the 2018 Koregaon Bhima violence, I presumed a mournful, weary voice would narrate her experiences during incarceration. Or a voice raging against those who scripted her arrest on October 28, 2018. But Bharadwaj can laugh as few can.

Activist #SudhaBharadwaj accused in the #BhimaKoregaon case has been released from Byculla prison on Thursday. The court had directed that she be released on a bond of Rs 50,000 and two sureties. However, the court has set some other stringent conditions similar to those set for co-accused #VaravaraRao who was granted bail on medical grounds.

From the Reliance Infrastructure workers’ arrest to the Naxalite angle, the Bhima Koregaon violence case is mired in multiple theories.
In 2018, months before the Pune police had launched a country-wide raid at the houses and offices of activists, academics and lawyers, the Maharashtra state Anti- Terrorism Squad (ATS) had had rounded up five men – all contractual workers at the Reliance Infrastructure Ltd – for their alleged involvement in the disruption caused at the anti-caste commemoration at Bhima Koregaon near Pune on January 1 that year.

Four years after the Bhima Koregaon violence that claimed one life and left multiple others injured with large scale damage to property, a chargesheet of at least 1,500 pages has been filed in the case against 41 people including Samasta Hindu Aghadi convener Milind Ekbote but excluding Sambhaji Bhide of Shiv Pratishthan in the case of attempted murder and rioting that was registered against them in January 2018.

The Pune Police have filed a first information report against seer Kalicharan Maharaj, Hindutva leader Milind Ekbote and four other persons for allegedly making inflammatory speeches at an event in the city, the officials said on Wednesday according to PTI…
One of the accused persons, Hindutva leader Ekbote, had allegedly made provocative speeches before the caste violence took place in Bhima Koregaon village in 2018. No action has been taken against him so far in this matter.

How lawyer Sudha Bharadwaj got bail after three years in jail / The Story of Her Incarceration

Still, it will take a week for her to be freed.
On Wednesday, a two-judge bench of the Bombay High Court granted bail to Sudha Bharadwaj, an activist-lawyer who has been jailed since August 2018 in connection with the Bhima Koregaon case.
However, she will have to wait for a week until December 8 to appear before a special judge of the National Investigation Agency Court in Mumbai, who will decide the terms of the bail.

The torturous practice of solitary confinement, whether for 24 hours or a large part of a day, remains a key feature of modern prisons, sometimes by another name. The continued use of an “anda” (egg-shaped) cell or high security cell in the Indian context appears to be, in effect, the use of solitary confinement — defined by many as cruel, inhuman and degrading treatment or torture — by another name. The news that eminent journalist and human rights activist and scholar implicated in the Bhima Koregaon case, Gautam Navlakha, has been moved to an “anda” circle in Taloja jail on October 12 is just another reminder that imprisonment itself appears inadequate for the state.

Sahba Husain says the rights activist has also been denied access to the library, canteen and jail’s green areas ever since he was shifted to the high-security Anda cell.
It was in April last year when human rights activist Gautam Navlakha surrendered before the National Investigation Agency (NIA) in the Bhima Koregaon case.
Since then Navlakha has been in prison — first in Delhi’s Tihar jail and then in the Taloja jail in Mumbai. Earlier this month, the 70-year-old, along with five other accused, was shifted to the high-security ‘Anda cell’ of the Mumbai prison.

While out on temporary bail in August, the rights activist sang a song written by Kabir Kala Manch’s Ramesh Gaichor for his friends and colleagues about the sordid conditions in prison.
Mumbai: Surendra Gadling, a human rights lawyer from Nagpur, has always considered courtrooms his stage. Between serious arguments, he would casually break into songs of cultural and political resistance. He would be commonly found invoking political theories and remembering shahirs from the Dalit community amid serious legal arguments. His court appearances usually attracted an eager audience from among his peers and junior lawyers.
