Jailed Shahir Sagar Gorkhe is not the only under trail prisoner who has been continually harassed and whose ‘Machchhardani’ stolen by the insolent jail administration. This is an attempt to condemn the unlawful treatment meted against the under trial prisoners and to safeguard their rights. Following is the account of a similar incident that was faced by another imprisoned writer and poet Ramesh Gaichor translated from the original written in Marathi.

I, Sagar Tatyaram Gorakhe, am a Political Prisoner under the Elgar Parishad Bhima Koregao Case, and have been locked up in the Taloja Central Jail since September 2020. It is with extreme distress that I inform you that since the very beginning the prison administration has treated the Bhima Koregao Case accused with utmost prejudice. As a result, the prison has become a torture camp for my co-accused and me. As you must be aware that it was the maltreatment by the prison administration that led to the custodial death of Father Stan Swami last year. Even today our basic human rights are being trampled over every day in the prison. It is because the situation has become absolutely unbearable that I must resort to an agonising hunger strike in protest. …

SAGAR Gorkhe, an activist and performer with cultural troupe Kabir Kala Manch, accused of inciting violence in the Bhima Koregaon (Elgar Parishad) case, has written to Maharashtra Home Minister Dilip Walse Patil announcing his hunger strike in protest against the conditions at Taloja jail.
Meanwhile, septuagenarian activist and journalist Gautam Navlakha, who is a co-accused lodged in the same prison, approached the National Investigation Agency (‘NIA’) seeking a mosquito net.

The Peoples Union for Civil Liberties welcomes the order of the Supreme Court dated 11.05.22 in the petition filed by Army veteran Major-General SG Vombatkere (Retired) as well as PUCL and a range of other petitioners challenging the constitutional validity of Section 124-A of the Indian Penal Code, 1860. In its petition, the PUCL had pleaded that owing to the development of constitutional law, the law of sedition of the colonial era had no place; it was overbroad, vague, arbitrary, violating the sacrosanct freedom of speech and expression, hence it was imperative to strike it down as it was unconstitutional.

The prime minister’s eloquent appeal on behalf of under-trial prisoners could not entirely erase the memory of incarcerated activists in the so-called Bhima-Koregaon case, for example, or protesters against the new citizenship laws.
The prime minister got it right. At the joint conference of chief ministers and high court chief justices, in which the Chief Justice of India delivered a speech reportedly mentioning how governments contributed to the courts’ caseload, Narendra Modi mentioned the staggering figure of 3.5 lakh under-trial prisoners in his own speech.

One of sixteen accused in the infamous Bhima Koregaon case, Gautam has been imprisoned in Taloja Central Jail, Navi Mumbai since 25 May 2020. For more than six months now, since 12 October 2021, the nearly 70 years old Gautam, an undertrial suffering from multiple health problems has been in solitary confinement in one of 33 cells in the ‘anda’ circle, the High Security Area of Taloja Jail, a space meant to segregate those guilty of heinous crimes.
